The term 'The Iconic Lodge' or 'us' or 'we' refers to the owner of the website whose registered office is in Bellagio, Via Valassina, 183, tax code and VAT number. 04062110137. The term 'you' refers to the user or viewer of our website. 

By using the website, you agree to abide by the Terms and Conditions of Sale outlined in this agreement and our Privacy Policy. This agreement applies to the use of this website and becomes effective upon registration or subscription process. If you do not agree to the terms, please do not use the website. Only individuals over the age of 18 or the age of majority in their country are allowed to use the website's services. Any unauthorized use is strictly prohibited. 

 

Intellectual property rights 

The Intellectual Property rights for all trademarks, names, images, photos, and text used on The Iconic Lodge's website are solely owned by The Iconic Lodge. Any unauthorized reproduction, manipulation, or usage of these logos, images, illustrations, and marks in any form or part, for any purpose, on any platform is strictly forbidden.


The Product purchases 

The terms of sale for products on this website are governed by the current General Terms and Conditions of Sale found on the website at the time of purchase. The Iconic Lodge reserves the right to change these terms at any time, and any changes will only apply to purchases made after the revised terms have been published.


Purchase procedure 

Please note that while we strive to make the photographs on our website as accurate as possible, there may be some differences due to the technical specifications and color resolution of the device used. We cannot be held responsible for any discrepancies in the product images due to these technical limitations.

In the event of a pricing error, we will do our best to rectify the situation and offer you the product at the correct price. If the mistake is detected before your order is processed, we may reject the order and notify you of the correct price. If the error is discovered after the order has been accepted, we will provide you with the option to cancel the order. Before finalizing your order, please double-check the contents of your shopping bag and fill out the order form as instructed on the website. The purchasing process is considered finalized when you receive the order form electronically and have verified the accuracy of the information. 


The order form and any personal information required for the purchase will be stored in our database for the time necessary to process the order. You agree that The Iconic Lodge and the Data Controller may collect, store, and process your personal data in accordance with EU Regulation No. 679/2016 (GDPR) and other relevant privacy laws, for the purpose of fulfilling your purchase made through our website.

Any additional use of your data for purposes beyond the purchase will only be done with your prior, explicit consent, in line with the Privacy Policy outlined on the website. If you have an account on the website, you can check the status of your order by logging in and going to the "My Orders" section. 

When making a purchase on the website, you need to provide accurate personal information. If any information changes, it's important to let us know so we can keep our records up-to-date and avoid sending messages or contact information to the wrong people.

You are responsible for all activity on your account, so make sure to keep your login information secure. If you violate these Terms of Use, we may cancel your registration, block your account, or restrict, suspend, or terminate your access to our website and services.

The Iconic Lodge allows you to cancel your website usage at any time by sending an email to info@theiconiclodge.com, which will be confirmed once processed.

The price for a Personalized Product will be charged at the time of order confirmation. Although the Personalized Product may not be immediately available for shipping, it will be delivered within the estimated time frame indicated on the Product page. All other Terms and Conditions outlined in these General Terms and Conditions of Sale apply to Personalized Products as well.

Please note that the website may contain links to third-party websites over which The Iconic Lodge has no control and cannot be held responsible for their accessibility or content. The products or services offered by these third-party websites do not imply endorsement by The Iconic Lodge.


Execution of contract 

Upon confirmation of the order, changes cannot be made. Before confirming, you must review and agree to the General Terms and Conditions of Sale, as well as confirm that you have read the information on personal data processing. The order will only be processed if it has been completed correctly and no errors are displayed by the Website.

After placing your order, you will promptly receive an email to the address provided in the order form acknowledging receipt of the order. This email will include a summary of the sale's Terms and Conditions, the product description, total order price including any shipping costs, address for complaints, and the summary document on the Cancelation right.

Please note, The Iconic Lodge reserves the right to not accept the order if there is a dispute relating to a previous order, if you have breached the Terms and Conditions of Sale on previous occasions, or if you have been involved in or suspected of illegal or fraudulent activities. In such cases, you will be notified by email within 30 days of receipt of the order, indicating the cancellation of the received order.

For the purposes of payment through other payment service providers, you confirm and warrant that you are the owner of the account used for the purchase. 


Price and method of payment 

The prices listed on the website include standard packaging fees, Value Added Tax (VAT) if applicable, but exclude shipping costs which are the responsibility of the customer to pay to The Iconic Lodge in addition to the displayed price. If there are any additional expenses, you will be informed and asked for your consent before being charged. To make a purchase, you must add the desired product to your shopping cart, complete the order form, choose a payment method, accept the Terms and Conditions of Sale, and submit the order. You understand that unawareness of any extra costs, fees, duties, taxes, or charges when making an order with The Iconic Lodge cannot be used as a valid reason to cancel the agreement and you cannot hold The Iconic Lodge accountable for these expenses.

Prices are listed in Euro and will be charged once the order is confirmed and after your card information has been verified, the card issuer has given authorization to debit the card. Payment may be made by credit cards, PayPal, and bank transfer. 

As the buyer, you confirm that you have legally obtained the funds used to pay for the products and any delivery charges. When paying with a credit card, you also confirm that you are the owner of the card and that all information entered, such as the card number, expiry date, and security code, is accurate. 

The Iconic Lodge also accepts payment through bank transfer to the following IBAN code: IT40F0326801604052515434760, BIC SELBIT2BXXX. In that case you will be responsible for covering any costs and expenses, including bank charges, associated with the transfer. The payment must be made within 7 working days from the date of the order confirmation. The purchased products will only be shipped after full payment has been received. If the payment fails or is not received within the specified time frame, the order will be canceled, and you will be notified.


Legal guarantee of Conformity 

As the buyer you are entitled to receive products that meet the specifications outlined in the order. Upon receiving the product, it is your responsibility to inspect it for any defects or irregularities. If there are any issues, you have the right to have the product remedied by The Iconic Lodge through repair or replacement, or alternative remedies as provided by Article 130 of Legislative Decree No. 206/2005. If a refund is required, it will be made through the same payment method used for the purchase or via bank transfer. You must inform The Iconic Lodge at info@theiconiclodge.com of your bank details to facilitate the transfer and ensure that the refund can be processed.

It is important to note that you must notify The Iconic Lodge of the lack of conformity within one (1) month of discovering the defect, otherwise you may lose your rights. To report a product defect, contact The Iconic Lodge at info@theiconiclodge.com.

Delivery 

All products are shipped directly from Italy. We offer a reliable delivery service for Italy and abroad. When you're placing your order, the available delivery options for your destination will be displayed and shipping costs will be calculated, at checkout. Delivery costs will vary depending on the service selected, and your item destination. For all international deliveries, shipping may incur additional charges, such as import duties. For our international customers, it is recommended to check with local authorities regarding any potential import duties that may be applicable.


Delivery of the Products is limited to specific countries and territories. If you don't see your location, please reach out to us. If necessary, you can place a new order with a different delivery address. The Iconic Lodge will send a shipping confirmation via email once the products are dispatched after the successful payment of the due amount. Such email shall contain a shipment tracking code and an exclusive link that will allow you to monitor the delivery in real time. 


The Products shall be delivered to the address indicated by the customer in the order. Delivery address cannot be modified once the order has already been shipped. No delivery at post office box will be made and we will not accept any purchase request with an address that may not be identified.


Our products are insured against theft and damage during shipment until the delivery, so in the event the loss or damage to the product occurs prior to the physical delivery to you or a third party appointed by you, The Iconic Lodge shall refund you any amounts already paid. 

In accordance with applicable legislation, the term within which the Iconic Lodge must deliver the items purchased is 30 (thirty) days from the date of execution of the contract, except in cases of force majeure. For pre-ordered products, personalized items, the delivery date shall be longer than 30 days and the Iconic Lodge shall deliver these items at the estimated delivery dates, or the estimated delivery period agreed with you.

To the extent permitted by the applicable legislation and by these general Terms and Conditions of Sale in case the delivery has not occurred within the above indicated term, you may ask The Iconic Lodge to make the delivery within an additional period. You still are entitled to repudiate the Contract if the ordered item is not delivered within the specified additional time frame. The Iconic Lodge shall, without undue delay, reimburse all sums paid under the Contract.

Delivery timing is estimated from the time your order is shipped, not when it is placed and should only be used as a guide. In the event The Iconic Lodge fail to execute the order, we shall refund any sums you already paid for the payment of the Product. If you have chosen bank transfer as the payment method, the delivery term shall start from the receipt of your payment.


In accordance with art. 63 of the Consumption Code, if there are any issues with the packaging or the items, such as damage or discrepancies in the number of parcels received compared to the delivery note, you are invited to refuse the delivery by the carrier/shipper or to accept the delivery "with reservation". Once you have signed the courier’s transportation document, you may not object to the external characteristics of the delivered goods. You are responsible for the risk of loss or damage to the items from the moment in which you or a third party appointed by you and other than the courier, physically takes possession of such items. At the time of delivery, a signature by an adult, over 18 years of age, or the age of majority in his country is necessary to verify that the packaging and the product are not damaged. Please inspect your order upon reception and contact us immediately if necessary.

In addition to any conventional warranties provided at the discretion of The Iconic Lodge, legal warranties under current legislation apply to the sale of products.

In the case you choose a courier different from those proposed during the purchase process, the risk of damage of the products is transferred to you already from the moment of handing the product to the courier. Any notification shall be notified from you to the courier.  

Orders are only processed on weekdays, excluding national holidays in Italy (New Year's Day and

Epiphany, Easter Monday, April 25th, May 1st, June 2nd, August 15th, November 1st, December 8th,

Christmas Day and Boxing Day).


Return policy and refunds 

Upon receiving an order, if you change your mind about your purchase, or if it is damaged, you can return it within fourteen (14) days from the day on which you received the items, or on which a third party you have appointed, who is not the courier, takes possession of the product delivered. For split orders, the relevant term shall begin on the day of delivery or collection of the latest item.

To exercise your right of cancellation and to start the return procedure, you must inform us of your decision by writing an email to returns@theiconiclodge.com before the period has expired. Please wait for confirmation from us before returning your items. 

To be eligible for a return, items must be returned in new condition, with the labels and in original packaging included. You must therefore ensure that the items are intact. The integrity of such items is essential for the exercise of the right of withdrawal. Please note that customized items cannot be returned. 

To complete your return, we require the number of orders along with a note indicating whether you want to exchange the product or a refund. For returns outside Italy, you will be responsible for the shipping costs and for the risk of loss or damage to the product during shipping, so we recommend you return to us the items using a trackable shipping service or purchasing shipping insurance.  

If you are seeking to return an item, it must meet specific criteria. To initiate the return process, you can reach out to us at returns@theiconiclodge.com.  Once your item has been returned, verified and the claim validated within 14 days from the day on which we receive the returned items, we will notify you that we have received your returned item and the approval or rejection of your refund. If your request for a refund is approved, the funds will be returned to you within 14 days of receiving notice of withdrawal, using the same payment method as the original transaction. This will be done without undue delay.

After your item is returned and approved, we will keep you updated if you have agreed to the replacement of the item with a different product of equal or greater value, for which you may need to pay the difference in price between the returned item and the new one. The exchange will be accepted by The Iconic Lodge subject to the availability of the new Products requested. Exchanges for items of equal or lower value are allowed for Apple Pay, and Wire Transfer orders. 

A voucher can also be issued with a value equal to the price paid for the returned item, to be spent, within one year from its issuance, for the purchase of another item. If the item was marked as a gift when purchased, shipped directly to you and defective, you will receive a gift credit card for the value of your return if approved. The delivery time for your exchanged product may vary depending on your location. To ensure that you receive the item you want, we recommend returning the original item and making a separate purchase for the new one once the return has been accepted. The items in the KushionMe Collection are unique and can only be exchanged for a different design or pattern. Limitation of liability 

We cannot assure the accuracy, completeness or timeliness of the information presented on this website. We do not provide any guarantees and will not be held accountable for any inaccuracies or missing information. We reserve the right to modify the website without prior notice. By using the information and content available on the website, you acknowledge that you are taking full responsibility for any potential risks and any issues that may occur, including system failures, delays, errors, omissions, or viruses. Some countries may not permit the limitation of liability, so this section may not be applicable to you.

The Iconic Lodge will not be held accountable for any indirect or resulting damages that a customer may incur from purchasing products unless there was evidence of fraud or extreme carelessness. If this limit of liability is disputed and proven, The Iconic Lodge's total responsibility to the customer will not exceed the cost of the purchased products.

 

Disputes and Place of jurisdiction 

The Terms and Conditions of Sale outlined here are governed by Italian law. If there's a dispute regarding the interpretation or application of these terms, the court in your country of residence (if it's in Italy) will have the exclusive right to hear the case. If you don't live in Italy, you can choose to either go to court in your country of residence or in Como, where The Iconic Lodge is registered. You also have the option to use alternative dispute resolution procedures or the European Commission's online platform for resolving disputes, available on the website http://ec.europa.eu/odr.
